On February 12, CEO of Rapid Recovery Solutions John Monderine reacts to an article published on NBC Connecticut, which details how aggressive collectors are inappropriately contacting debtors.
According to the article posted on NBC Connecticut, a group of staff reporters from the news organization set out to investigate how intrusive and aggressive some debt collectors can be. The group, called Troubleshooters, found that one South Windsor, Conn. woman had a collector contact her father. The article said the collector lied to her father, claiming that one of her friend’s was in a car accident and they needed to contact her.
In the article, Connecticut Banking Commissioner Howard Pitkin said, “Normally, debt collectors will be a little assertive but there's a line that they can't go over where it goes into abuse.”
John Monderine, CEO of one of Long Island’s leading commercial collection agencies Rapid Recovery Solution, said many agencies go about collecting a debt the wrong way. “The most important thing for your business is collecting the debt,” he said. “But people are getting wise and they know their rights. Scare tactics are unlawful, inappropriate and people don’t give in to them anymore.”
Last year, the article said Connecticut’s Department of Banking and the Attorney General receive a high number of complaints about debt collectors. Over 300 complaints were filed, many of which focused on abusive phone calls.
However, there are laws against this kind of behavior, the article said. According to the Federal Trade Commission, it is illegal for a collector to report false debts and threaten consumers. After the initial call, the article said the consumer has the right to tell the collector when and where to call in the future. If the collector disrespects that, it’s against the law. The FTC also said collectors cannot call you at work, or at home after 9 p.m. unless it’s agreed upon by the consumer.
Monderine said there’s more ways to collect a debt and earning a consumer’s trust is the best route. “The only way you’re going to get a debt resolved is to befriend the consumer and offer them a variety of solutions,” he said. “People respond to help, especially when they’re knee deep in financial problems. It’s best to provide consumers with plans to pay off the debt as easily as possible without threatening them.”
