Berger was a few minutes late to the meeting and the other county commissioners did not acknowledge him when he entered the room.
Chris Anglin, Berger's attorney, defended Berger's late arrival to the meeting.
"In the two-and-a-half years he was less than ten minutes late over 75% of the time, so I would say he was on-time today," said Anglin.
The attorney also addressed Berger's future with the board.
"He's glad to have resumed his seat and he's looking forward to resuming his work on behalf of the people of New Hanover County and he's glad that he was able to make the agenda meeting today. He looks forward to filling out the remainder of his seat," said Anglin.
Anglin said he was unsure whether the other county commissioners would try to remove Berger from the board again.
